Your privacy is important to Evergreen Care, Inc. (“Evergreen AI”, “our”, “us” or “we”) as is your trust in our Services. This Privacy Policy describes how Evergreen Care, Inc. together with our affiliates and subsidiaries handles personal information in connection with our website and proprietary software platform (collectively, the “Services”), and when you otherwise interact with us.  By using our Services, you consent to this Privacy Policy. We may supply a different privacy policy in relation to some of our Services, and that policy will apply to any information provided to or collected by us pursuant to those Services.

 

The Evergreen AI website and proprietary software platform (the “Service”, “Platform”) is owned and operated by Evergreen Care, Inc. This Privacy Policy describes:

  • When and with whom your information is shared

Information Collected Directly From You

When you use Evergreen AI, we may collect the following personally identifiable information and Personal Health Information directly from you related to providing the Services:

 

  • Contact Information; such as your name, phone number, postal address and email address, which we will use for example, to contact you, for identification purposes and to create your account etc.

  • Health Coverage Information; we may also request that you provide us with your date of birth, employment, health status and other information relating to your health insurance coverage such as, health plan member number, last four digits of your social security number, diagnoses, procedure/condition, and treatment.

  • “Personal Health Information” or “PHI” has the meaning provided by the Health Insurance Portability and Accountability Act (HIPAA) and includes information related to your treatment or care such as health records, health histories, test results, bills, insurance information, etc.

  • Geolocation Information; may also be collected to provide our Services and improve your user experience if you allow us access to your location through your device permissions.

You can choose not to provide us with any or all of the information we specify or request, but then you may not be able to register with us and we may not be able to provide the Service to you.   If you correspond with us via email, we may gather in a file specific to you the information that you submit.  Please see How We Use and Share the Information We Collect for more information.

Information Collected From You Automatically When You Use the Service

Like many other websites, we also collect information through cookies and other automated means. Information of this sort includes:

Technical information about your browser and mobile device: This information is used to help us optimize the Service for common browsers and devices.

 

Usage information such as the features and correspondence from our Platform that you interact with: We may collect and use this behavioral information to generate statistics about users and how the Services are being used and to facilitate advertisements. 

 

IP addresses, log file information, web beacons, cookies, tokens and device identifiers: These are alphanumeric identifiers that help us to distinguish between unique browsers and devices in order to avoid showing you the same information twice, keep you logged into our Platform, prevent duplicate actions, prevent duplicate coupon redemptions and improve your experience.  The information we collect from cookies may include your IP address, browser and device characteristics, referring URLs, and a record of your interactions with our Service. By using the Service, you are consenting to such use of cookies. Most Web browsers can be set to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. Crashes and error reports: If you encounter a crash or error while using our Service, we may generate a crash report that includes technical, usage and, if you are logged in, your account information so that we can diagnose and potentially prevent the problem in the future.

Information Collected From Other Sources

We may also periodically obtain both personal and non-personal information about you from third parties that are authorized to share the information.  These parties may install tracking scripts and cookies when you integrate them with the Service.  This policy only covers the use of cookies by Evergreen AI. Do-Not-Track

Your browser or device may include “Do-Not-Track” settings or functionality. Currently, our systems do not recognize browser “Do-Not-Track” requests. The information collection and disclosure practices, and the choices that we provide to users, will continue to operate as described in this Privacy Policy, whether or not a Do-Not-Track signal is received.

  • In connection with the sale, transfer or financing of a significant part of Evergreen Care, Inc. business or its assets;

  • As required by law, such as in conjunction with a subpoena, government inquiry, litigation, dispute resolution or similar legal process.

We want you to feel confident using the Services, however no data transmission or storage system can be guaranteed to be 100% secure. You are responsible for maintaining the confidentiality of your Services access information and password and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your password.

Data Retention

We may retain your information as permitted by law for as long as your account is active or as needed to provide you Services, to operate our business, to enable us to communicate with you, for our safety, research, evaluation of use, analytics or troubleshooting purposes, or to satisfy our legal or contractual obligations. If you close your account, we may still retain certain information associated with your account as permitted by law in accordance with this section.  Where required, we will anonymize or delete the information we collect when we no longer need it for the uses described above.

 

Third Party Services and Links to Other Websites

 

Our website may contain links to other websites, many of which have their own privacy policies. Be sure to review the privacy policy on any site you are visiting or providing information to. This Policy does not apply to the practices of those third-party plug-ins, exchanges, networks or websites that Evergreen Care, Inc. has a relationship with or other companies or individuals that Evergreen Care, Inc. does not own, employ, manage or control.

 

Children's Privacy

We restrict use of the Service to individuals age 18 and above, and do not knowingly seek or collect personal information from anyone under the age of 18. Users over the age of 18, however, may engage with the Service to request support for minor dependents. In such cases, all interactions will be with the adult user only, and records of such interactions will be linked to the adult user’s account.

  • The purposes for collecting, using, or selling personal information.

Note that the CCPA defines “business purpose” broadly; We use service providers for a number of business purposes that require access to our systems that hold personal information, including but not limited to supplying cloud data storage, maintaining the security of our systems, and providing customer support.

Right to Request Deletion: The CCPA also provides California residents the right to request that we delete personal information under certain circumstances, subject to a number of exceptions. Certain Evergreen Care, Inc. Services, however, may require your consent to have your personal information shared with Evergreen Care, Inc. to provide the Services or to allow us to use and disclose your personal information to provide the Services. When you exercise your rights, you may lose access to certain aspects of Evergreen Care, Inc.’s  Services that require your personal information to perform the Services.

This Privacy Policy is intended to cover collection of information from residents of the United States and is not intended for users located outside the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States by us as data controller and as data processor.  By signing up for and using the Service you agree to this transfer.
